This Affiliate Program Terms & Conditions Agreement (“Agreement”) is made between WriteRush (“WriteRush.ai”), and you, the Affiliate, for participation in the WriteRush Affiliate Program.
By registering as an Affiliate, you acknowledge that you have read, understood, and agree to be legally bound by the terms of this Agreement. If you do not agree to these terms, do not participate in the WriteRush Affiliate Program.
1. Introduction & Acceptance
WriteRush offers Affiliates the opportunity to promote WriteRush’s products and earn commissions based on qualified referrals.
By activating your affiliate account:
- You confirm that you are at least 18 years old.
- You confirm that you have the legal authority to enter this Agreement.
- If representing a business, you confirm that you are authorized to act on its behalf.
If you do not want to be part of the program, simply do not activate or use your affiliate account.
1.1 Affiliate Registration
All applications undergo verification. Please ensure your information is complete and accurate. The review process may take 3 – 5 business days.
If approved:
- You will receive a welcome email.
- You will gain access to your Affiliate Dashboard, which includes your referral links, analytics, reporting tools, and promotional materials.
If additional details about your promotion methods are required, we may email you for clarification. Failure to respond within 5 days may result in rejection.
2. Promotional Materials Provided by WriteRush
WriteRush will provide Affiliates with approved marketing assets (“Promotional Materials”), which may include:
- Banner graphics
- Button links
- Text links
- Landing page links
- Approved WriteRush branded assets
Affiliates must use only the Promotional Materials provided or approved in writing by WriteRush.
Affiliates must also link to WriteRush.ai only through the designated affiliate links provided in their affiliate dashboard.
3. Use of Promotional Materials
Your use of WriteRush’s promotional materials must follow these rules:
- No modification allowed
You may not alter, edit, or modify WriteRush’s Promotional Materials unless WriteRush provides written approval. - Purpose of use
Promotional Materials may only be used to promote WriteRush’s products and services. - Link usage
All Promotional Materials must link exclusively to WriteRush.ai pages specified in your dashboard. - Paid advertising restrictions
You may not run paid ads using WriteRush’s brand keywords, branded terms, or any confusingly similar phrases unless explicitly authorized. - No misleading marketing
You may not make false, exaggerated, or misleading claims about WriteRush.
4. License to Use WriteRush Materials
WriteRush grants you a non-exclusive, non-transferable, revocable license to use Promotional Materials solely for the purpose of promoting WriteRush and generating referrals.
This license terminates automatically upon termination of your affiliate account.
5. Intellectual Property Rights
WriteRush retains all ownership rights, trademarks, copyrights, and intellectual property embodied in the Promotional Materials.
Nothing in this Agreement grants you ownership of:
- WriteRush trademarks
- WriteRush branding
- WriteRush copyrighted materials
- Any WriteRush intellectual property
You may not claim ownership of, register, or misuse any WriteRush brand-related asset.
6. Relationship of the Parties
This Agreement does not create:
- employment,
- partnership,
- joint venture,
- agency, or
- franchise
between WriteRush and the Affiliate.
You operate as an independent contractor.
You may not bind WriteRush to any agreements or make any promises on WriteRush’s behalf.
7. Commission Structure
To help Affiliates understand how referral earnings accumulate, the following commission framework applies:
7.1 Commission Percentage
Affiliates earn a 30% recurring yearly commission for each paid subscription referred.
This applies to:
- Initial purchase
- Each successful monthly and yearly renewal, for as long as the subscription remains active under the referred customer
7.2 Qualifying Purchases
A “Qualifying Purchase” is defined as:
- A sale completed by a new customer who arrived via your unique affiliate link
- A purchase that is not cancelled or refunded within WriteRush’s 14-day money-back guarantee window
- A renewal payment made by your referred customer
7.3 Non-Qualifying Transactions
No commission will be paid for:
- Purchases canceled or refunded within 14 days
- Purchases where the affiliate cookie was not tracked
- Fraudulent, self-referral, or artificially generated leads
- Any transaction made by the Affiliate themselves
8. Additional Commission Conditions
To maintain transparency and fairness, the following rules apply:
8.1 Commission Maturity
WriteRush provides a 14-day money-back guarantee.
Therefore:
- Commissions mature only after 14 days
- Commissions appear as “Pending” until the refund period passes
- Matured commissions become eligible for withdrawal
8.2 Cookie Tracking
WriteRush uses a 60-day tracking cookie, meaning:
- If a visitor purchases within 60 days of clicking your affiliate link, you receive credit
- If the user clears cookies or blocks tracking, WriteRush can only track identifiable referrals
8.3 Last-Click Attribution
The Affiliate whose link was clicked most recently before purchase receives the commission.
8.4 Withdrawal Threshold
Affiliates may request payouts only when:
- Their account balance reaches at least $100, and
- They have at least one matured qualifying referral
8.5 Payment Method
- Payments are issued via PayPal or Bank Transfer, using the PayPal email saved in your affiliate settings.
- Affiliates are responsible for any transaction fees (e.g., PayPal or Bank Transfer fees).
- All payments are made in USD.
8.6 Payout Frequency
WriteRush issues payouts:
- During the first week of each month
- For all matured commissions available at that time
8.7 Accuracy of Records
WriteRush maintains accurate commission data.
If discrepancies arise, WriteRush will correct them within 14 days after confirmation.
9. Referral Fraud & Manipulation
WriteRush strictly prohibits:
- Self-referrals (“buying through your own link”)
- Fake accounts
- Coupon manipulation
- Bot-generated clicks or leads
- Any action intended to artificially inflate commission numbers
If WriteRush detects fraudulent activity:
- Your affiliate account may be terminated immediately
- All unpaid commissions may be forfeited
- Legal action may be pursued if necessary
10. Affiliate Representations & Warranties
The Affiliate warrants that:
- You have full legal authority to enter this Agreement.
- Your website or promotional channels do not contain:
- pornography
- hate speech
- defamation
- violent or harmful content
- illegal activity
- You own or have rights to use any intellectual property shown on your site or channels.
- You will not misrepresent WriteRush or its services.
- You will comply with all applicable advertising, email, and online marketing regulations.
11. Coupon, Deal & Discount Restrictions
WriteRush may offer coupons to selected affiliates.
Unless you have been explicitly assigned a coupon:
- You may not promote unassigned coupons
- You may not bid on WriteRush coupon-related keywords (e.g., “WriteRush discount”, “WriteRush coupon”)
- You may not mislead customers by implying unauthorized discounts
Violations may result in suspension or termination of your affiliate account.
12. Confidentiality
Any internal information disclosed to you by WriteRush that is not publicly available is considered Confidential Information.
You may not disclose:
- Dashboard data
- WriteRush internal processes
- Beta features
- Any non-public business information
unless required by law.
13. Taxes
Affiliates are solely responsible for:
- Reporting earnings
- Filing taxes
- Paying all applicable income or business taxes
WriteRush will not withhold taxes on commissions.
14. Limitation of Liability
WriteRush is not liable for:
- Loss of profits
- Loss of revenue
- Loss of data
- Indirect or consequential damages
- Interruptions, delays, or termination of service
- Issues arising from affiliate tracking failures
Your sole remedy for dissatisfaction with the program is to terminate your participation.
15. Term & Termination
This Agreement becomes effective upon affiliate activation and remains active until terminated by either party.
15.1 Termination by Affiliate
You may terminate your account at any time by written notice.
15.2 Termination by WriteRush
WriteRush may terminate your account:
- With or without cause
- With a minimum 30-day notice (general case)
- Immediately in case of policy violation or fraudulent behavior
15.3 Effect of Termination
Upon termination:
- Use of WriteRush materials must stop immediately
- All unpaid commissions from fraudulent or policy-violating activity will be forfeited
- Legitimately matured commissions may still be paid at WriteRush’s discretion
16. Severability
If any provision of this Agreement is found unenforceable, the remainder of the Agreement shall continue in full effect.
17. Headings
Section titles are for convenience only and do not affect legal interpretation.
18. Entire Agreement
This Agreement constitutes the entire understanding between WriteRush and the Affiliate.
It supersedes any prior agreements or representations.
19. Amendments
WriteRush may update this Agreement at any time.
Continued participation after changes take effect constitutes acceptance of the updated terms.
